Harvey Weinstein faces another legal setback as New York retrial ends without decision
The jury was unable to decide on the 2013 rape charge involving former aspiring actress Jessica Mann
Harvey Weinstein’s latest rape retrial has ended in a mistrial after jurors failed to reach a unanimous verdict, marking another setback in one of the most closely watched legal battles stemming from the #MeToo movement.
The 74-year-old former Hollywood producer was accused of raping former aspiring actress Jessica Mann in a New York hotel room in 2013.
However, the jury in the Manhattan trial—composed mostly of male jurors—ultimately became deadlocked.
Judge Curtis Farber declared the proceedings a mistrial after stating that the panel was “hopelessly deadlocked,” with no reasonable likelihood of reaching a decision.
Following the ruling, lawyers for both sides have been instructed to return for a hearing in June. It remains unclear whether Manhattan prosecutors will pursue a fourth trial.
Manhattan District Attorney Alvin Bragg confirmed that his office will “consider our next steps in consultation with Ms Mann,” adding praise for the complainant’s persistence.
In a statement, Bragg said: “Her perseverance and bravery are inspiring to the members of my office, and more importantly, to survivors everywhere.”
Weinstein has denied all allegations of non-consensual sex throughout the proceedings.
The former Miramax co-founder was previously convicted in New York in 2020 on charges involving Jessica Mann and former production assistant Miriam Haley.
However, that conviction was later overturned on appeal, leading to a series of retrials.
In June 2025, Weinstein was again convicted of sexually abusing Haley, while being acquitted of separate charges involving former model Kaja Sokola.
The jury, however, could not reach a verdict on the third-degree rape charge involving Mann, resulting in the latest retrial.
Weinstein is currently serving a 16-year prison sentence in California following a separate 2022 rape conviction. He still faces additional sentencing of up to 25 years for the Haley-related charges.
Despite multiple convictions and ongoing legal proceedings, Weinstein continues to deny all allegations of non-consensual sex.
