Couple escape child neglect charges after abandoning infant on Florida beach
Deputies said the incident on a Florida beach could have proved fatal for the infant
A Florida couple who left their six-month-old baby alone in a beach tent for approximately an hour while they walked along the shore with their three other children will avoid criminal prosecution, provided they stay out of trouble for the next 12 months.
Brian Wilks, 41, and Sara Wilks, 37, had been facing child neglect without great bodily harm charges following the incident on a Florida beach, but entered into a deferred prosecution agreement with authorities. Under the terms of the deal, the charges will be dropped if the couple complete 25 hours of community service, attend a parenting class, and are not arrested within the next year.
Beachgoers raised the alarm
Other beachgoers noticed the unattended infant and called 911 before the couple returned. "I am calling regarding a child that has been unattended, a baby it's probably like 6 months, maybe 5 months," the caller told dispatchers. Deputies and paramedics arrived to assess the baby, with witnesses telling officers the parents had not been seen for some time — "They probably have been gone an hour," one witness said, according to body-camera footage obtained by Law&Crime.
Parents dispute witnesses, then admit the truth
When Brian and Sara Wilks eventually returned to the scene, they initially claimed they had remained in the vicinity. Multiple witnesses contradicted that account, and deputies placed the couple under arrest. "This is a big, big issue," a deputy told them at the scene. The Department of Children and Families took custody of all four children until family members were able to collect them.
The couple, who were visiting Florida from Texas, later admitted to deputies that they had placed the baby under the tent for a nap before leaving with the other children, saying they had lost track of time.
"While deputies waited for South Walton Fire District personnel to arrive and assess the infant, the parents returned to the scene, where both admitted to placing the child under the tent for a nap before leaving with their other children, claiming they lost track of time," the Walton County Sheriff's Office said in a press release.
Deputies warn of potentially fatal consequences
As Law&Crime previously reported, deputies stated at the time that the situation could have ended fatally for the infant. The sheriff's office used the case to issue a broader public warning: "This incident serves as a reminder that even brief moments of inattention can have serious consequences and can sometimes lead to tragic outcomes."
