Virginia father indicted for aggravated murder in infant death

A Virginia father was indicted by a grand jury on Monday, in connection with the death of his three-month-old daughter. Fairfax County Commonwealth’s Attorney’s office announced that 28-year-old Misael Lopez Gomez faces charges of aggravated murder and felony child abuse following an extensive law enforcement investigation into the infant's death.

PEOPLE reported that police officers initially responded to a report of an unresponsive infant in the 3400 block of Lake Street in Bailey’s Crossroads on March 27, 2026. Officers performed cardiopulmonary resuscitation at the scene until fire and rescue personnel arrived to continue life-saving procedures. Emergency responders transported the infant to a local hospital, where medical staff subsequently pronounced her dead.

Detectives and medical personnel observed physical evidence consistent with abuse during the initial inquiry. A preliminary autopsy conducted by the Office of the Chief Medical Examiner determined that the infant died from blunt force trauma. Police confirmed that the three-month-old child was under the direct care of Lopez Gomez at the time of her death.

During a preliminary hearing in the Juvenile and Domestic Relations Court, a police detective testified that Lopez Gomez admitted to striking his daughter repeatedly during questioning. Prosecutors originally charged Lopez Gomez with second-degree murder following his arrest in April 2026. However, the Commonwealth’s Attorney’s office later requested the grand jury to return an indictment for aggravated murder based on the severity of the evidence.

Commonwealth’s Attorney Steve Descano stated that the rare and egregious nature of the case required a higher penalty under state law, emphasising that his office prioritises prosecuting serious violent offences. Following his initial arrest, the US Department of Homeland Security identified Lopez Gomez as an illegal immigrant from Guatemala and issued an arrest detainer to ensure he remains in custody throughout the legal proceedings.
