Elon Musk's xAI sued a user, alleging he used the company's Grok chatbot to generate child sexual abuse material and non-consensual explicit deepfakes by bypassing the platform's built-in safety measures.

The lawsuit, filed Tuesday in the US District Court for the Northern District of Texas, names Terry Wayne Harwood, who was arrested earlier this year in South Carolina on multiple counts of alleged sexual exploitation of a minor.

CNN said it had contacted Harwood's attorney in the criminal case for comment.

xAI alleges user bypassed Grok safeguards

According to the complaint, Harwood created multiple xAI accounts and used what the company described as "misleading prompts" to generate sexually explicit images of both minors and adults from non-sexual photographs without the subjects' knowledge or consent.

The company alleged Harwood intentionally attempted to circumvent Grok's built-in safeguards designed to prevent the creation of explicit content involving minors.

"Defendant breached the xAI Terms of Service and Acceptable Use Policy by leveraging Grok to generate non-consensual sexually explicit images and CSAM," the lawsuit states, referring to child sexual abuse material.

Company cites earlier warning on illegal AI use

The lawsuit follows criticism earlier this year over a Grok feature that enabled so-called "digital undressing," including AI-generated images involving children.

After reports of increasing non-consensual sexual deepfakes, Musk and xAI announced they would crack down on illegal use of the chatbot.

The lawsuit quotes Musk's January 6 post stating: "Anyone using Grok to make illegal content will suffer the same consequences as if they upload illegal content."

xAI alleges Harwood's actions exposed the company to significant legal and reputational risks.

xAI seeks damages

The company is asking the court to declare that Harwood violated its Terms of Service and Acceptable Use Policy, along with awarding unspecified damages.

According to the lawsuit, xAI says it has suspended 52,222 accounts and submitted 73,604 reports to the National Center for Missing & Exploited Children in 2026, which it says have resulted in at least 244 arrests.

The lawsuit marks one of the first known cases in which an AI company has taken legal action against a user over the alleged creation of child sexual abuse material using a generative AI system.
