Elon Musk’s artificial intelligence firm, xAI, has filed a significant lawsuit against the State of Colorado, contending that a new regulatory framework unconstitutionally restricts the free expression of its chatbot, Grok.

The legal challenge, lodged in the US District Court on Thursday, 9 April 2026, targets Senate Bill 24-205. This legislation, scheduled to take effect on 30 June, seeks to eliminate "algorithmic discrimination" in high-risk sectors such as employment, housing, and finance.

However, xAI argues that the law effectively compels speech by forcing developers to align their models with state-sanctioned views on equity rather than remaining objective.

The company maintains that the statute creates a "contradictory situation" by requiring differential treatment to address historical discrimination, which xAI suggests undermines the goal of equal treatment.

In its court filing, xAI stated that the law "severely burdens the development and use of AI" and jeopardises its mission to build a "maximally truth-seeking" system.

The firm expressed further concern that a "patchwork" of varying state regulations will stifle competition and create immense confusion for software developers operating across multiple jurisdictions.

This litigation follows a similar challenge by xAI against California’s transparency laws in December. The broader debate over AI governance has drawn comments from David Sacks, co-chair of the President's Council of Advisors on Science and Technology, who recently advocated for a unified national framework to replace fragmented state rules.

Sacks, alongside other industry luminaries, was appointed to the council by President Trump in March 2026 to streamline governance and ensure the United States remains a leader in the global "Golden Age of Innovation.
