Kim Zolciak temporarily loses primary custody of children in court ruling
The custody dispute between the former couple remains ongoing in court
Reality TV personality Kim Zolciak has temporarily lost primary physical custody of her four children following a new court ruling in her ongoing legal dispute with ex-husband Kroy Biermann.
A Georgia judge issued a temporary order granting Biermann primary physical custody of the couple’s children, K.J., 14, Kash, 13, and 12-year-old twins Kane and Kaia, while the former couple continues to share joint legal custody.
According to court documents obtained by E! News, Biermann will also retain final decision-making authority on key matters involving education, religion, and non-emergency medical care.
The ruling marks a significant development in the couple’s ongoing custody battle, which began after their divorce in May 2023 following 11 years of marriage.
Zolciak, 47, responded to the decision in a statement, saying she is focused on resolving the matter in court.
She expressed hope for a full hearing where she believes she will have the opportunity to present her side of the case in detail.
The dispute escalated after Biermann filed an emergency custody request, alleging that Zolciak was “unstable and unfit” as a parent and prioritizing personal interests over the well-being of the children. Those claims have been firmly denied by Zolciak and her legal team.
Her attorney has stated that the allegations are without factual basis and vowed to challenge them in court, describing the filing as an attempt to damage her reputation.
Biermann had previously sought sole custody in March, citing concerns over what he described as “blatant mismanagement” of parenting responsibilities.
Zolciak, however, rejected those accusations, calling them false and defamatory.
At an earlier stage of the proceedings, a judge implemented a temporary arrangement that placed the children in Biermann’s care while Zolciak participated in court-ordered therapy sessions.
The existing parenting plan remains in effect until further modification by the court.
The custody case remains ongoing as both parties prepare for additional hearings in the coming months.
