Prince Harry at risk of losing ‘substantial costs’ in legal fees: Judges warns

Prince Harry has been warned regarding the mounting costs in his lawsuit against the Associated Newspapers, publishers for the Daily Mail, by Judge David Cook and Justice Nicklin.

The two judges addressed the claimants in the case, one of whom is the Duke of Sussex, while ruling that they “must have the ‘clearest possible understanding’ of the consequences arising from their legal action amid escalating costs and the financial risk built into their insurance arrangements,” per GB News.

“The court heard that the seven claimants hold a combined insurance policy worth £14.1 million to cover Associated Newspapers’ legal costs should they all lose their case,” the publication added.

While the petitioners could also face losses more than their individually estimated share worth £2.35 million if anyone withdraws from the case or if some of the parties happen to win their legal challenge but not the others.

“If that means the individual claimants need to reassess their ATE cover, that can only be in their own best interests,” the latest ruling stated, referring to the After The Event Insurance, a policy which covers legal costs.

Prince Harry’s case against the British media conglomerate further includes singer Elton John and his husband David Furnish, model Elizabeth Hurley, actress Sadie Frost, and activist Baroness Lawrence.

The case is set for trial in January 2026 for nine weeks, with a preliminary hearing scheduled on December 18.
