A grieving mother has initiated a wrongful death civil suit against Tesla Inc. following a harrowing accident that claimed the lives of her teenage son and his father.

Shantorria Herring filed the complaint in the United States District Court for the Northern District of Georgia on 31 March, following the 23 December 2024 tragedy.

The suit alleges that 14-year-old Karter Breon Smith and his father, Margarret Smith, were killed when their 2021 Model 3 veered off a Georgia highway and struck a tree.

According to the legal filing, the vehicle "abruptly departed the road" and immediately burst into flames. The complaint highlights a terrifying "human touch" detail: a passer-by reportedly rushed to assist but was unable to open the doors because the electric-powered handles were "inoperable."

Consequently, both occupants were allegedly trapped as the car suffered a "thermal runaway," a volatile battery chain reaction. Herring’s legal team argues that the car’s Autopilot and self-driving features were defectively designed, causing the vehicle to accelerate unexpectedly and fail to brake.

Herring is seeking unspecified damages for the "pre-impact shock and fright" and the immense physical suffering her son experienced.

Her attorney, Quinton Seay, stated that his client remains devastated, noting, “It has been a struggle for her to even talk about it.”

Tesla has not yet issued a formal response to the allegations. This case adds to a growing list of legal challenges for the electric vehicle manufacturer regarding its semi-autonomous driving software and battery safety protocols.
